As Pen America stated in “Chasm in the Classroom, Campus Free Speech in a Divided America”, “Failures of political leadership, persistent racism and bigotry, the weaponization of speech on digital platforms, and gaps in civic education are combining to undermine the consensus for an open marketplace for ideas”. The most prevalent campus free-speech legislation being introduced in state legislatures today is drafted from model bills produced by the Goldwater Institute, which typically states that all outdoor “green space” should be a public forum. Perhaps the most misunderstood category of unprotected speech on the college campus is that of fighting words. In reality, the concept of fighting words is so narrow that it would be difficult to comprehend what truly meets that definition in modern society. Modern college campuses are fraught with profane messages on clothing, tasteless cheers at sporting events, political cartoons of a sexual nature, and a host of other messages that some people find offensive.
